Neil Carter joined BHP from South Tyneside Council where he was the Principal Solicitor managing a team responsible for providing legal advice to the Council’s planning, building control and highways services. Neil has also worked for Gateshead Council and has ten years experience of local government law and practice. He currently acts for a number of large and medium sized developer clients as well as Local Authorities.

Neil is part of the BHP Develop team. Neil’s expertise lies in advising on the following:-

• Section 106 Agreements, Section 278 and Section 38 Agreements, including drafting of bespoke forms
• Lawful Development Certifi cate applications
• Planning and Highways enforcement
• Drafting of planning and enforcement Appeal submissions
• Objections to planning applications
• Planning prosecutions
• Compulsory Purchase
• Village Green applications
• Public Rights of Way applications
• Stopping up/diversion of Highways
• Instructing Counsel on Planning Inquiries
• Advising on Judicial review and other challenges to decision making
• Local Government Ombudsman Complaints and Standards Board Complaints

Neil’s background in the public sector and his experience as a Planning Solicitor compliments the practical knowledge and experience within the BHP Develop team. In particular, Neil is used to working with Planners on a range of projects including residential & industrial, retail, town centre, rural, waste recycling, coal & mineral extraction schemes.

BHP Develop is a multi disciplinary planning practice offering the full range of planning services. The team advise on a range of projects from major infrastructure projects through to small scale domestic proposals.
